Terms of Use for Kickstand Connect (this “Agreement”)
Please read this Agreement carefully so that you can understand the rules and expectations for using Kickstand Connect, as well as what your own responsibilities are.
Important Terms:
“Kickstand Connect” means Kickstand Connect (in this document, “us”, “we, “our”).
“Services” means any appointment with any provider on Kickstand Connect, like mental health counselling, peer support, employment & education support, groups etc.
Requirements
You agree that: a) you are 12 years old or older, b) you live in Alberta, Canada, c) all information you provide to Kickstand Connect will be true and accurate.
Your Account
Booking and attending appointments at Kickstand Connect requires you to have an account. In order to make an account, you will need to give us the following information:
- Your name
- Your email address
- Your date of birth
- Your postal code
- Gender identity
- Racial or ethnic identity
You will not be able to make an account without this information. It is important that you give us the correct information so that we can make sure we provide the right service to the right person!
You are responsible for this account. This means that you should not share your password with anyone or use someone else’s account. If you think that someone else has access to your account, please let us know by emailing
privacy@mykickstand.ca.
You will be solely responsible and liable for any activity that occurs under your account. “Liable” means that you are accountable under the law for how your account is used. Basically, we don’t want you doing anything illegal or misleading (don’t lie and pretend to be someone else). This also means that we don’t want you tampering with (i.e., hacking or unlawfully accessing) our security features or using our logos without permission.
Codes of Conduct
You are responsible for all activities using your account to the Kickstand Connect Platform. You agree that when using the Kickstand Connect Platform you will follow these rules:
- You will not do anything illegal.
- You will not allow any other person to access or use the Kickstand Connect Platform on your behalf or using your account.
- You will not provide false or misleading information to Kickstand Connect.
- You will not engage in activity that us fraudulent, false or misleading (e.g., impersonating someone else) or libelous or defamatory.
- You will not tamper with or compromise any aspect of the Kickstand Connect Platform.
- You will not circumvent or attempt to circumvent any restrictions on access or any of the security measures associated with the Kickstand Connect Platform.
- You will not remove or alter any proprietary symbol or notice, including copyright notice, trademark, or logo displayed in connection with the Kickstand Connect Platform.
- You will not decompile, disassemble, reverse engineer or otherwise copy any software associated with the Kickstand Connect Platform.
- You will not copy or record any content associated with the Kickstand Connect Platform, including any of the virtual sessions.
- You will not engage in activities that are harmful to others.
- You will not allow others to use the Kickstand Connect Platform to do any of the above.
If you do any of the above, your account may be cancelled or suspended, and you may be removed or otherwise banned from using Kickstand Connect Platform without warning.
Security and Your Use of the Kickstand Connect Platform
You are responsible for the security of:
- Your email address associated with your use of the Kickstand Connect Platform
- Your Kickstand Connect Platform password
- Your device (e.g., cell phone or computer/laptop)
Termination of your account
Kickstand Connect may cancel or suspend your account if you do not follow the rules in this Agreement, or for any other reason. If Kickstand Connect cancels your account, then your access to and use of the Kickstand Connect system automatically ends, your account will be deleted, and you will no longer be able to log into your account.
If you do not wish to use Kickstand Connect services anymore, you can choose to delete your account yourself.
Disclaimer and Legal
The Services provided through Kickstand Connect are provided on an “AS IS” and “AS AVAILABLE” basis. Kickstand Connect as well as its suppliers and licensors do not claim to supply any warranty of any kind in relation to the Services, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Kickstand Connect, its suppliers and licensors, do not make any warranty that the Services will be error free or that access by the user to the Services will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.
Jurisdiction and Applicable Law
Except to the extent any applicable law provides otherwise, this Agreement and any access to or use of our Services will be governed by the laws of Alberta and Canada.
The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the courts of Alberta.
The Kickstand Connect Platform is governed by the
Freedom of Information and Protection of Privacy Act (
FIPPA) and
Alberta’s Health Information Act (HIA) and its supporting regulations, as the same may from time to time be amended, re-enacted or replaced.
Changes
Kickstand Connect reserves the right, at our sole discretion, to modify or replace the terms of this Agreement at any time.
If we make changes that are important for you to know about, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will give you a reasonable period of time after which the new terms/Agreement will take effect.
If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.
Your continued use of our Services will be subject to the new terms.
Privacy Statement for Kickstand Connect
Privacy, or who will see your profile or read your information?
- Kickstand Connect will collect your personal information and your personal health information (called your “Information” from now on) when you use our services.
- During or before an appointment with a provider, you might be asked to complete a health survey, like for example a survey asking questions about any mental health symptoms.
- After an appointment with a provider, they will write a note on your profile or “health chart.” The only people who will be able to see your Information is your care team. This means that those providers who you currently meet with can see and update your Information.
- If you see different providers at the walk-in clinic, each provider will be able to see your Information for the purpose of that current appointment. Kickstand Connect providers follow a “Need to Know” rule, which means they only look at those parts of your Information that they need to help you during that appointment.
- We want to be able to give you the best care possible. This means that, sometimes, it can be helpful to share your Information with other services or our partner organizations. Examples of some of our partner organizations are Alberta Health Services. We only access and/or share your Information in order to get you the right care and supports. If we need to share your Information with a service that is outside of our Kickstand partners, we will ask you for permission first (unless it is an emergency situation, which you can read about in the Limits to Confidentiality section).
- Your information may also be used to evaluate and improve Kickstand services or for approved research projects that have been properly vetted by a research ethics committee. Wherever possible your info will be de-identified before it is used for these purposes. Where, however, the program evaluation or research cannot be carried out using de-identified info, we will still ensure that the results of any such program evaluation or research project cannot be used to identify you before we share those results with anyone.
How can I access my Information?
You have the right to access, update and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law.
You may request access, updating and corrections of inaccuracies in personal information we have in our custody or control by emailing us at
privacy@mykickstand.ca. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.
- You can always see your profile information, including demographics, and any results from a health survey that you’ve completed, on your Kickstand Connect account. Your Kickstand Connect account is protected by your password and only you and any providers on your Kickstand Connect care team have access.
- You can get a copy of your Information from Kickstand Connect by submitting a request in writing to privacy@mykickstand.ca.
- Your information will remain on your account for if and when you choose to access Kickstand services again.
- You can choose to completely delete your account and information by submitting a request in writing to privacy@mykickstand.ca
Security and Confidentiality
- We work hard to keep your Information safe, confidential, and secure and we have safeguards in place for this. The database that stores your Information is secure and follows all privacy laws about storing health information. All Kickstand Connect providers use secure, password-protected accounts and keeping your information private is part of their code of ethics as health professionals.
- If we find out that your Information has been accessed, used or shared in a way that it’s not supposed to be, we will tell you as soon as we can.
Your responsibilities in keeping your Information safe and secure:
- If it is possible, try to attend your Kickstand Connect appointment in a private place where no one can overhear you.
- You are responsible for the security of your own computer, device, tablet, mobile, email service and WiFi
- You are also responsible for your password for Kickstand Connect, do not share it with anyone!
Limits to Confidentiality
The following list is things that cannot stay private between you and your provider. In any of these situations, your provider may need to share your information with other people, services, or organizations. But they will always talk to you
first about what they need to share and why, so they can work to keep you safe and supported.
- If you are having thoughts about hurting yourself or someone else. Your care provider will tell you if they think that you are at risk and you can work together to make a care plan to keep you safe.
- If your provider is worried that you might be unsafe at home
- If you (or your family/caregivers) are involved in a court case and your health documents get subpoenaed by a judge. “Subpoenaed” means that a judge can ask to see someone’s health records for a court case and could ask to see your health chart from Kickstand Connect.
- If you have experienced physical or sexual abuse from a health professional, for example, like a doctor, counsellor or therapist, nurse.
What happens if the Privacy Statement Changes?
We will let all Kickstand Connect users know about potential changes to our privacy policy by posting such changes on our website (
https://mykickstand.ca/) or by sending out an email. You will have time to read it before any changes are made.
